Preamble and identity

These terms govern the relationship between Pembet TSANGHOU (Entrepreneur individuel exerçant sous le nom commercial Lovy World, registered with the Registre National des Entreprises (RNE) under SIREN 106 311 962), whose registered office is located at 2 rue Françoise Dolto, 44800 Saint-Herblain, France, hereinafter “the Publisher”, and any person using the services offered on SpeakAsYou, hereinafter “the Client”.

Purpose

SpeakAsYou is a language-learning service in the form of a recurring subscription. It provides continuous access to a set of lessons, conversations with Léa, and progress-tracking tools, in the languages subscribed to. It is neither the delivery of a good, nor the supply of downloadable digital content: the service is consumed over time, on the Publisher’s servers.

Description of offers

Four subscription tiers are offered, each available in a monthly or annual billing period. Each tier carries a daily lesson quota and a monthly voice-time quota. The number of languages subscribed to within a single subscription is capped, at three languages at the date of these terms; additional languages follow a degressive formula. The prices in force, the quotas, the language cap and the degressive formula are indicated on the offers page, fed by the Publisher’s internal catalogue. A subscriber sees the prices and quotas published at the time of their subscription maintained as long as it remains active, under the conditions set out in the “Modifications” section.

Seven-day free trial

Subscription to a paid offer opens a free trial period of seven days. No charge is made during this period; the first charge takes place on the eighth day. Access to the portrait, prior to any subscription, requires no bank card. The subscriber may end the trial at any time from their subscription page: if the subscription is cancelled within the seven days, no amount is debited.

Acceptance

Subscription to a paid offer entails full and complete acceptance of these terms. No modification may be enforced against the Publisher without its written consent.

Prices and display

Current prices are displayed on the offers page and fed from the internal catalogue. They are stated in euros. VAT not applicable, Article 293 B of the French General Tax Code.

Payment

Payment is processed by the Stripe provider. No banking data is stored by the Publisher: card entry takes place exclusively on the payment provider’s secure forms, which alone retains this data.

Duration and tacit renewal

Each subscription, monthly or annual, is automatically renewed at the end of its period, unless the subscriber cancels. For annual subscriptions, a written reminder is sent to the subscriber between three months and one month before the expiry, informing them of their non-renewal option (article L215-1 of the French Consumer Code). Failing this reminder, the subscriber may cancel their subscription at any time without penalty and obtain a refund of amounts charged after the initial expiry date.

Cancellation

Cancellation of a subscription may be exercised at any time from the subscriber’s subscription page, via the payment provider’s billing portal (article L215-1-1 of the French Consumer Code). It takes effect at the end of the current paid period. Access to the service is maintained until that expiry. No pro-rata refund of the remaining days is granted; the current paid period remains due in full.

Right of withdrawal

At the time of subscription, the subscriber expressly waives their right of withdrawal, by ticking a distinct box, in exchange for immediate access to the service. This waiver is collected in accordance with article L221-28 13° of the French Consumer Code, which sets aside the right of withdrawal for the supply of digital content without a material medium, subject to three cumulative conditions: performance of the service begins with the consumer’s prior express agreement; the subscriber expressly acknowledges that they lose their right of withdrawal; a confirmation is sent to them by email on a durable medium. These three conditions are met by the check-box at subscription, by its wording which separately states the agreement and the acknowledgement of the loss, and by the confirmation email sent following the subscription. In return, the seven-day free trial period plays the role of a reflection period: no charge is made before the eighth day, and cancellation remains accessible at any time.

Acquired access

The CEFR levels validated, the progress and the pedagogical content produced by the subscriber (completed lessons, tracked error categories) are not erased by the sole fact of a subscription cancellation. Upon cancellation, the generation of new lessons stops at the end of the paid period. The pedagogical data already collected remains, under the conditions set out in the privacy policy and subject to the retention periods indicated therein.

Charter of use

The Client undertakes to make personal and fair use of SpeakAsYou. In particular, the following are prohibited: reselling or sharing the account, automated content extraction, generating a portrait or conversation with Léa containing unlawful, hateful, or knowingly misleading statements towards the model. A serious breach may lead to account suspension, without prejudice to the reimbursement of unused amounts.

Liability and cap

The Publisher is bound by a best-efforts obligation regarding the availability and quality of the service. Its liability, all damages combined, may not exceed the amount actually received from the Client during the last twelve months.

Personal data

The processing of personal data is described in the privacy policy. The Client has the right to access, rectify, erase, restrict, object to and port their data. The cookies set by the site are described in the legal notice.

Mediation

In accordance with Article L612-1 of the French Consumer Code, the Client is entitled to free recourse to a consumer mediator. As of today, the Publisher has joined no consumer mediation scheme, and the Client is informed of this before subscribing. The European Online Dispute Resolution platform is also available at https://ec.europa.eu/consumers/odr.

Jurisdiction

These terms are subject to French law. Failing amicable resolution, any dispute falls under the competent courts according to the common-law rules applicable to consumers.

Modifications

The Publisher may modify these terms at any time. Significant modifications are brought to the Client’s attention by email, with a reasonable period before they take effect.
